The main objective of TicketBAI Bizkaia is to reduce tax evasion and improve efficiency in tax management. To this end, it maintains a detailed electronic record of commercial transactions so that the Bizkaia Regional Treasury can more accurately track the income and taxes generated by all companies.

Taxation in Bizkaia to date

As you probably know, the three provinces of the Basque Country have a different taxation system from the rest of Spain's autonomous communities and provinces. Therefore, they do not have to adhere to exactly the same standards and requirements.

What is the current situation in Bizkaia and when will it become mandatory?

As is the case in Spain, TicketBAI Bizkaia is mandatory for public companies and any private company that operates with them. However, this requirement is still only partial, as full implementation has not yet taken place.  

To be more specific, TicketBAI Bizkaia is gradually becoming mandatory across the entire business sector. In fact, last November 2023, the General Assembly of Bizkaia gave the green light to the provincial regulation for the definitive implementation of the TicketBAI system. This mandate establishes that all companies must integrate into the new system between January 1, 2024, and January 1, 2026.

In turn, although we refer to TicketBAI Bizkaia, we should rather refer to it as the system used by the three Basque provinces. This is because it is the new invoicing system for all of them, which has been implemented in the Basque Country and has been in operation in the provinces of Guipúzcoa and Álava since 2022.

Calendar for its mandatory implementation in Bizkaia

Likewise, the Bizkaia Batuz portal displays the detailed calendar with the six-monthly windows for mandatory incorporation into the system. As anyone can see, TicketBAI Bizkaia will be mandatory for all companies on a progressive basis, and they must sign up for it according to these deadlines:

  • 01/01/2024: Corporate tax payers that are not micro-enterprises or SMEs and belong to any sector. 
  • July 1, 2024: Micro-enterprises and SMEs that contribute to corporate income tax, individuals, and entities under the income allocation regime, but from the following sectors:
    • Industrial, manufacturing, construction, transportation, finance, legal, insurance, rental, healthcare, and other activities except education and culture.
  • January 1, 2025: Micro-enterprises and SMEs that contribute to corporate income tax, individuals, and entities under the income allocation regime, but from the following sectors: 
    • Wholesale trade, retail trade, hospitality, real estate restoration, hairdressing, and other personal services. 
  • 07/01/2025: Individuals and entities under the income allocation regime, but who work in the wholesale or retail trade, hospitality, real estate restoration, hairdressing, and other personal services sectors. 
  • 01/01/2026: On the one hand, any company exempt or not exempt from corporate income tax, as well as non-profit entities in any sector. Also micro-enterprises and SMEs that contribute to corporate income tax, individuals and entities under the income allocation regime in the agriculture, livestock, and fishing sectors, education, and cultural services. 

In short, as in the rest of Spain, although TicketBAI Bizkaia is already mandatory for any company that operates with the Public Administration, it will be mandatory for all self-employed workers and companies within two years, without exception. 

Are there any exemptions from the TicketBAI system?
